On October 3, Larry Lewis, city planner, provided me with a 10-year old "Geologic and Hydrologic Investigation of the Rodovsky Properties, Yachats, Lincoln County , Oregon " by Charles Rosenfeld, Registered Professional Geologist in Corvallis . Discussing "Hydrology" Rosenfield states " Once the forest has been removed it is critical to preserve the infiltration and drainage of the precipitated water by the `throughflow' process. This means that the developer and contractor must use extreme caution to leave most of the organic soils intact, and to encourage infiltration by preserving and replanting vegetation." Recommendations in this study have not been followed! Is this the " site analysis by a professional geologist and civil engineer" that is being used for compliance and enforcement of the City of Yachats Comprehensive Land Use Plan and Codes?

On October 25, 2005. Larry Lewis, City Planner, provided me with a March 15, 2004 " Geotechnical Evaluation for Elk Ridge Subdivision, prepared for Jonathan Monschke, P.O. Box88, Yachats , Oregon 97498 and received by the Yachats City Planner October 2004. The OGS (Oregon Geotechnical Services), Portland , report states " Geologic Hazards - Using the results of our field exploration, available literature, and this Geotechnical evaluation, we identified the following geologic hazards applicable to the site.
Chronic Hazards - Slope stability
Catastrophic Hazards, earthquake related phenomena, massive landsliding
According to available sources there are no mapped geologic hazards such as costal recession, ocean flooding, erosional bluff, and tsunami flooding."

WARNING LETTERS (file #114801) issued October 14, 2005 by the Oregon Department of Environmental Quality to the Contractor and developers of captioned sub-divisions for " Failure to Register for NPDES 1200-C Permit Coverage " and " Failure to Properly Install and Maintain Erosion Control Measures ." Separate Warning Letters to: W.W. Construction, Robert D. Wheeler, agent P.O. Box 1150 , Newport , OR 97365 for Sunset Heights and Blackstone 1&2; Jonathan Monschke (for Blackstone 1&2), P.O., Box 88 , Yachats , OR 97498 ; Pacific 101 Development, LLC c/o Scott Beckstead, Attorney, P.O./ Box L, Florence , OR 97439 for Sunset Heights . "To correct the violation, you must submit a NPDES 1200-C Permit application and fee to DEQ by October 25, 2005.
